Arizona Medical Insurance Laws, Regulations & Policies

There are several Arizona health insurance laws and regulations that are put in place to protect policyholders living in the state. Residents who need to get an individual plan after they have left a group plan with an employer are protected under the federal law HIPAA. This law prohibits Arizona insurance providers from imposing a waiting period for pre-existing health conditions.

Once accepted into a health plan, Arizona state law prohibits insurers from canceling coverage if the policyholder becomes sick or is injured. Additionally, residents have the right to temporary continued health coverage from a previous employer under the federal law COBRA.

The following medical services are required to be covered under Arizona health insurance law:

  • Screening for breast cancer
  • Care for some diabetes-related conditions
  • Continuity of health care for pregnant women
  • Contraceptives

Also, small groups of two to 50 people are guaranteed to be accepted for Arizona health insurance coverage under state law.

Arizona Health Insurance High Risk Pool

The Patient Protection and Affordable Care Act established temporary national high risk pools to provide health insurance coverage to people with pre-existing conditions. The Pre-Existing Condition Insurance Plan (PCIP) in Arizona requires enrollees to pay monthly premiums and out-of-pocket expenses like normal Arizona medical insurance plans.

Residents with PCIP pay around the same amount that people without pre-existing conditions pay in the private insurance market. Recent estimated monthly premiums for Arizona residents are $323 for ages 0 to 34; $387 for ages 35 to 44; $495 for ages 45 to 54; and $688 for ages 55 and older.  Individuals with pre-existing conditions will be able to receive health insurance coverage for physician and hospital visits, prescription drug coverage, behavioral health services, emergency visits and surgeries, and more.

Arizona residents are eligible for the PCIP plan if they are a United States’ citizen, have been denied standard health insurance coverage for a pre-existing condition, and have been uninsured for six months.
