There are several Florida health insurance laws and regulations that are put in place to protect policyholders living in the state. In the Sunshine State, residents have guaranteed access to Florida health insurance coverage in certain situations. You cannot be denied coverage if:
- You were diagnosed with breast cancer and completed treatment more than two years prior
- You were fully covered by a group health plan for at least three months
- You are HIPAA-eligible
- You move out of an insurance company’s service area and are looking for a new plan
The federal law COBRA (Consolidated Omnibus Reconciliation Act) gives any Florida resident the right to continue group health insurance coverage if he or she leaves a job that provided group coverage. Also, small groups of one to 50 people are guaranteed acceptance to a Florida health insurance plan.
Florida health insurance law requires all health plans cover certain medical services. Those services are:
- Screening for breast cancer
- Care for some diabetes-related conditions
- Continuity of care for pregnant women
- Vaccinations for children
Florida medical insurance plans must also set the same coverage limits and maximums for mental health conditions as they do physical health conditions; this is known as mental health parity.
Florida Public Health Dental Program
The Public Health Dental Program is committed to promoting and developing community-based preventive, educational and treatment programs that emphasize the elimination of oral health disparities.
Florida Health Insurance High Risk Pool
The Patient Protection and Affordable Care Act established temporary national high risk pools to provide health insurance to those who have pre-existing conditions. The Pre-Existing Condition Insurance Plan (PCIP) in Florida is not a public program and enrollees will have to pay monthly premiums and out-of-pocket expenses like normal Florida health insurance plans.
Florida residents with PCIP pay around the same amount that people without medical conditions pay on the private insurance market. The estimated monthly premium rates for Florida residents are $363 for ages 0 to 34; $435 for ages 35 to 44; $556 for ages 45 to 54 and $773 for people 55 and over. There is also a $2,500 deductible. The Florida health insurance high risk pool provides eligible residents health insurance coverage for hospital and doctor visits, prescription drugs, emergency services, and more.
Individuals are eligible to enroll in the Florida PCIP if they are a United States’ citizen, have an existing medical condition, and have been uninsured for six months. The Florida Legislature opted to have the federal government run the high risk pool and residents can find more information at http://www.healthcare.gov/index.html.
