South Carolina Medical Insurance Laws, Regulations & Policies

There are several South Carolina health insurance laws and regulations that are put in place to protect policyholders living in the state. Under state law, South Carolina insurance providers are allowed to look at an applicant’s health status to determine if they are accepted into coverage and to set monthly premiums.

If an applicant has a pre-existing health condition, he or she might be turned down for coverage but can purchase a plan through the South Carolina Health Insurance Pool. This high risk pool accepts all applicants regardless of health status. But it is important to note that these plans can be quite expensive.

South Carolina health insurance plans must also cover certain medical services according to state mandates. Those required services include:

  • Screening for breast, prostate and cervical cancer
  • Care for pregnant women
  • Contraceptives/li>

Additionally, South Carolina insurance providers are also required to set equal coverage limits and maximums for mental health conditions and physical conditions. And residents who have recently left a group health plan with an employer and are HIPAA-eligible have special protections under federal law, as well.

South Carolina Health Insurance High Risk Pool

The Patient Protection and Affordable Care Act established temporary national high risk pools to provide health insurance to those with pre-existing conditions. Residents in South Carolina with pre-existing conditions are able to get health insurance from the Pre-Existing Condition Insurance Plan (PCIP). This works similar to regular South Carolina health insurance plans and requires enrollees to pay affordable premiums and out-of-pocket costs.

Enrollees in the South Carolina PCIP pay around the same amount that people without medical conditions pay for health insurance. The estimated premiums for South Carolina residents are $301 for ages 0 to 34; $361 for ages 35 to 44; $462 for ages 45 to 54; $642 for ages 55 and older. The plan has a $2,500 deductible, which has to be met before health insurance benefits kick in. There is also an out-of-pocket limit set at $5,950 a year. Residents who are eligible for the plan will have access to health insurance coverage for prescription drugs, doctor and hospital visits, emergency services, and more.

Individuals may apply for the South Carolina PCIP program if they are a United States’ citizen, have n existing medical condition, and have been without health insurance for six months. For more information on the South Carolina health insurance high risk pools visit
