Virginia Medical Insurance Laws, Regulations & Policies

There are several Virginia health insurance laws and regulations that are put in place to protect policyholders living in the state. Most Virginia insurance providers will look at your health status before they accept you into coverage and set your premiums. However, there are two Virginia insurance providers that cannot deny your application and cannot impose permanent exclusion periods. These are CareFirst Blue Cross Blue Shield and Anthem Blue Cross Blue Shield.

Virginia health insurance law requires that all health plans cover certain medical services such as:

  • Patient care costs in clinical cancer trials
  • Screening for prostate, cervical, colorectal, and breast cancer
  • Medical care for pregnant women
  • Newborn baby health screenings
  • Vaccinations for children

Virginia insurance providers must also cover mental health conditions equally to physical health conditions. Additionally, Virginia residents who are HIPAA-eligible have certain protections under federal and state law. Once you are accepted for coverage, insurers are not allowed to cancel your coverage simply because you get sick or are injured.

Virginia Health Insurance High Risk Pool

The Patient Protection and Affordable Care Act established temporary national high risk pools to provide health insurance to those with pre-existing conditions. Residents in Virginia with pre-existing conditions can get health insurance coverage through the Pre-Existing Condition Insurance Plan (PCIP). This works similar to normal Virginia health insurance policies and requires enrollees to pay affordable premiums and out-of-pocket costs.

Enrollees in the Virginia PCIP pay around the same amount that people without pre-existing conditions pay for health insurance. The estimated monthly costs for Virginia residents is $289 for ages 0 to 34; $347 for ages 35 to 44; $443 for ages 45 to 54; $616 for ages 55 and older. The plan has a $2,500 deductible, which must be met before health insurance benefits are covered. There is also a $5,950 out-of-pocket limit for a year. Virginia residents who are eligible for the plan will have access to health insurance coverage for hospital and doctor visits, emergency services, prescription drugs, and more.

Individuals may apply for the Virginia PCIP program if they are a United States’ citizen, have been uninsured for six months, and have an existing medical condition. For more information on the Virginia health insurance high risk pools visit
